This Fraud Warning (the "Warning") informs users of the BitMoment platform (the "Platform", the "Service", "BitMoment") about typical fraud schemes in P2P cryptocurrency trading and about protective measures. This document is informational and cautionary in nature and does not limit other provisions of the Platform's documents.
This Warning forms an integral part of the User Agreement. By using the Service, you confirm that you have read this Warning, agree to it and undertake to comply with it. See also: User Agreement, Platform Rules, Risk Disclosure, AML/KYC Policy.
1. General Provisions
1.1. The Service is operated by BitMoment. The applicable law and the procedure for resolving disputes are determined by the User Agreement.
1.2. The Platform provides a technical capability for P2P interaction and escrow, is not a party to the transactions between users and does not guarantee the good faith of counterparties. Compliance with these recommendations reduces, but does not eliminate, the risk of fraud; the user is responsible for decisions to enter into a trade.
2. Basic Security Rules
2.1. All communication and settlements — only through the Platform. Do not move to third-party messengers and do not accept offers to "deal directly". Escrow and disputes do not operate outside the Platform.
2.2. Do not release a cryptoasset before payment is actually received. Confirm payment and receipt of funds only after the funds are actually credited and verified against your own account, not against a screenshot.
2.3. Check the requisites and the matching of names. A discrepancy between the payer's name and the requisites is a sign of a third-party-account scheme ("money mule").
2.4. Do not disclose codes, passwords, 2FA codes or seed phrases to anyone. Platform staff never request them.
3. Typical Fraud Schemes
| Scheme | Signs and protection |
|---|---|
| Fake payment screenshot | The counterparty sends "confirmation" of a transfer that did not occur. Protection: verify receipt against your own account, not against an image. |
| Pressure and haste | A demand to urgently release the cryptoasset "before the bank window closes". Protection: act only upon actual receipt of funds; the payment window is fixed. |
| Moving off the Platform | A proposal to move to a messenger, "exchange directly, it's cheaper". Protection: refuse; there is no protection outside the Platform. |
| Chargeback | Payment followed by a reversal of the transfer. Protection: use reliable methods, keep the correspondence in the trade chat, and attach evidence in a dispute. |
| Payment from a third-party account | Payment by a third party without disclosure. Protection: require the name to match; report it to support — this is also an AML risk. |
| Phishing | Fake sites, emails, "support" in private messages. Protection: check the page address, do not enter data via links from emails, do not trust "support" outside the official channels. |
| Fake "support" | A person poses as a member of staff and requests access/codes/a transfer. Protection: official support is only @BitMomentSupportBot and the stated addresses; codes and transfers are not requested. |

4. What to Do If You Suspect Fraud
4.1. Do not confirm payment and do not release the cryptoasset. Record the correspondence and evidence in the trade chat.
4.2. Initiate a dispute over the trade — escrow remains locked until the moderator's decision (see the Platform Rules).
4.3. Report to support: @BitMomentSupportBot or support@bitmoment.pro. For matters relating to AML and official requests — legal@bitmoment.pro.
5. Liability and Limitations
5.1. To the maximum extent permitted by applicable law, the Platform is not liable for losses caused by the actions of counterparties or third parties, the user's failure to follow these recommendations, the taking of communication and settlements outside the Platform, or user errors.
5.2. The Platform is entitled, at its sole discretion, to apply the control measures provided for by the Platform Rules and the AML/KYC Policy, including the suspension of transactions, the freezing of funds and blocking, without prior notice. Freezing is not a confiscation; the return of funds is possible after the grounds for retention have been eliminated, in the manner established by the said documents.
5.3. The user waives in advance any claims against the Platform in respect of the discretionary powers lawfully exercised by it, to the maximum extent permitted by applicable law. The recognition of any provision as invalid does not entail the invalidity of the remaining provisions; an invalid provision is applied to the maximum extent permitted by applicable law. The applicable law and dispute resolution are determined by the User Agreement.
